These Terms of Service (“Terms”) govern your use of jomofilmstudio.com and any purchases made through it. By using our Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.
Trademarks and Intellectual property
“JOMO Film Studio,” our logo, and associated brand names are trademarks of JOMO Film Studio, whether or not they appear with a ™ or ® symbol. All films, podcast episodes, photography, writing, product designs, and other content on this Site are owned by JOMO Film Studio or used with permission, and may not be copied, reproduced, distributed, or used to create derivative works without our prior written consent.
copyright complaints (DMCA)
If you believe content on this Site infringes your copyright, send a written notice to studio@jomofilmstudio.com including: (1) a description of the copyrighted work, (2) the location of the allegedly infringing material on our Site, (3) your contact information, and (4) a statement made in good faith that the use is unauthorized. We will investigate and remove infringing content where appropriate.

products and orders
Product listings, descriptions, and pricing are subject to change without notice.
We reserve the right to refuse or cancel any order, including in cases of suspected fraud or pricing errors.
Orders placed through our Studio Store are fulfilled by our print-on-demand partner, Printful. Production and shipping timelines are estimates and not guaranteed delivery dates.
If we offer any subscription or recurring payment product, cancellation will be made no more difficult than sign-up.
payment and sales tax
Payments are processed securely through our third-party payment providers. By placing an order, you represent that you are authorized to use the payment method provided. Applicable sales tax will be collected on orders where required by law.
acceptable use
You agree not to use the Site for any unlawful purpose, to attempt to gain unauthorized access to our systems, to infringe our intellectual property, or to interfere with the Site’s normal operation. We reserve the right to suspend or terminate access to the Site for any user who violates these Terms.
disclaimer of warranties
The Site and products are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law.
limitation of liability
To the fullest extent permitted by law, JOMO Film Studio’s total liability arising out of or relating to your use of the Site or any product purchased shall not exceed the amount you paid for the product giving rise to the claim. JOMO Film Studio is not liable for any indirect, incidental, special, consequential, or punitive damages.
indemnification
You agree to indemnify and hold harmless JOMO Film Studio, its owners, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, violation of these Terms, or infringement of any third-party right.
dispute resolution and arbitration
You and JOMO Film Studio agree to resolve any dispute arising from these Terms or your use of the Site through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, on an individual basis rather than in court, except that either party may bring an individual claim in small claims court. YOU AND JOMO FILM STUDIO EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Subject to the arbitration provision above, any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Seminole County, Florida.
Force majeure
JOMO Film Studio is not liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, labor disputes, carrier delays, or acts of government.
severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy and Shipping & Returns Policy, constitute the entire agreement between you and JOMO Film Studio regarding the Site.
changes to these terms
We may update these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
