JOMO Film Studio LLC ("JOMO Film Studio," "we," "us," or "our") operates jomofilmstudio.com (the "Site"). We respect the intellectual property rights of others and expect our users, customers, and community to do the same. This policy explains how we handle claims of copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA"), and qualifies JOMO Film Studio for the DMCA's "safe harbor" limitations on liability as a service provider under 17 U.S.C. § 512(k)(1).

This policy is governed by and interpreted in accordance with the laws of the State of Florida, consistent with our Terms of Service, and applies to all content submitted to, posted on, or hosted through the Site, including product reviews, comments, uploaded media, and any other user-generated content.

1) Filing a notice of claimed infringement

If you believe that content on the Site infringes a copyright you own or control, you may submit a written notice to our Designated Agent. To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Identification of the copyrighted work claimed to have been infringed, or, if multiple works at the Site are covered by a single notice, a representative list of those works.
Identification of the material claimed to be infringing, along with information reasonably sufficient to allow us to locate it on the Site (a specific URL is strongly preferred).
Your contact information, including your name, mailing address, telephone number, and email address.
A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Notices missing any of these elements may be considered incomplete and may not obligate us to act. We will remove or disable access to material identified in a valid notice expeditiously, consistent with our obligations under the DMCA.

Please note:

Section 512(f) of the DMCA imposes liability — including damages, costs, and attorneys' fees — on anyone who knowingly and materially misrepresents that content is infringing. Before filing a notice, please make sure you are certain the use is not authorized and is not a fair use.

2) Counter-notification

If you believe material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Agent. To be effective under 17 U.S.C. § 512(g)(3), your counter-notification must include:

Your physical or electronic signature.
Identification of the material that was removed or disabled, and the location where it appeared before removal.
A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which JOMO Film Studio may be found), and that you will accept service of process from the person who filed the original takedown notice or their agent.

Upon receipt of a valid counter-notification, we will forward it to the original complaining party. If that party does not notify us within 10–14 business days that they have filed a lawsuit seeking a court order to restrain you from the allegedly infringing activity, we may restore the removed material, consistent with 17 U.S.C. § 512(g)(2)–(3).

Please note:

Filing a false counter-notification carries the same § 512(f) liability described above.

3) Repeat infringer policy

As required under 17 U.S.C. § 512(i)(1)(A) to maintain our safe harbor eligibility, JOMO Film Studio has adopted and will reasonably implement a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We maintain records of valid takedown notices received and will act on a good-faith basis to identify repeat infringement and take appropriate action, up to and including permanent account termination and removal of access to the Site.

4) Third-party content and platforms

JOMO Film Studio's Site may integrate with or link to third-party platforms and services (including but not limited to Stripe, Printful, Squarespace, and Google Analytics) used to operate the Site and fulfill orders. This policy applies to content hosted directly on jomofilmstudio.com. Claims relating to content hosted on a third-party platform should be directed to that platform's own designated agent and copyright process.

5) No waiver of other rights

Nothing in this policy limits JOMO Film Studio's right to remove or disable access to any material at our discretion, at any time, for any reason, including material we reasonably believe violates our Terms of Service, independent of any DMCA notice.

6) changes to this policy

We may update this policy from time to time to reflect changes in the law or our practices. The "Last updated" date above will reflect the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised policy.
